Azerbaijani President signs decree on ensuring activities of Innovation Agency under Ministry of Transport, Communications and High Technologies

On February 22, President Ilham Aliyev signed a decree on ensuring the activity of the Innovation Agency under the Ministry of Transport, Communications and High Technologies.

 

The Decree states:

 

“Guided by Clause 32 of Article 109 of the Constitution of the Republic of Azerbaijan, in connection with the execution of Decree No.325 of the President of the Republic of Azerbaijan dated November 6, 2018 “On Establishment of the Innovation Agency under the Ministry of Transport, Communications and High Technologies of the Republic of Azerbaijan” I decide:

 

1. to approve “The Regulations of Innovation Agency under the Ministry of Transport, Communications and High Technologies of the Republic of Azerbaijan” (attached).

 

2. to approve “The Structure of Innovation Agency under the Ministry of Transport, Communications and High Technologies of the Republic of Azerbaijan” (attached).

 

3. to establish that the primary statutory fund of the Innovation Agency under the Ministry of Transport, Communications and High Technologies of the Republic of Azerbaijan (hereinafter the “Agency”) is 500 000 (five hundred thousand) manats and is formed at the expense of the State budget.

 

4. to charge the Cabinet of Ministers of the Republic of Azerbaijan:

 

4.1. to bring the acts of the President of the Republic of Azerbaijan in line with the present Decree and submit proposals to the President of the Republic of Azerbaijan within three months;

 

4.2. to inform the President of the Republic of Azerbaijan of bringing the normative legal acts of the Cabinet of Ministers of the Republic of Azerbaijan in line with the present Decree within three months;

 

4.3. to exercise control over the compliance of normative legal acts of the central executive bodies with the present Decree and inform the President of the Republic of Azerbaijan on its execution within five months;

 

4.4. to evaluate state property transferred to the balance of the Agency in accordance with Article 6.4 of Decree No.325 of the President of the Republic of Azerbaijan dated November 6, 2018 “On the Establishment of the Innovation Agency under the Ministry of Transport, Communications and High Technologies of the Republic of Azerbaijan” and within three months submit to the President of the Republic of Azerbaijan relevant proposals for consideration in the Agency’s authorized capital;

 

4.5. to implement control over the execution of Part 6 of the present Decree while preparing normative legal acts affecting innovation activities;

 

4.6. to resolve other issues arising from the present Decree.

 

5. to charge the Ministry of Transport, Communications and High Technologies of the Republic of Azerbaijan:

 

5.1. to coordinate programs (projects) financed by foreign states and international organizations with a view to supporting innovation activities in the territory of the Republic of Azerbaijan;

 

5.2. to take measures to coordinate normative legal acts specified in Part 6 of the present Decree;

 

5.3. to prepare within a month and submit to the President of the Republic of Azerbaijan the draft of rules for using the Agency funds.

 

6. Central executive authorities, legal entities and public entities created on behalf of the state and whose control  packet of shares (stocks) belongs to the state, in accordance with Article 46 of the Constitutional Law of the Republic of Azerbaijan “On Normative Legal Acts” ensure coordination of the normative legal acts prepared by them, which will affect the innovation activity, with the Ministry of Transport, Communications and High Technologies of the Republic of Azerbaijan prior to submitting to rule-making body.

 

7. The Ministry of Finance of the Republic of Azerbaijan shall provide financing in the amount specified in Part 3 of present Decree.

 

8. The Ministry of Justice of the Republic of Azerbaijan shall ensure coordination of normative legal acts and normative acts of central executive bodies with the present Decree and inform to the Cabinet of Ministers of the Republic of Azerbaijan”.
