Licensing
The issuance of licenses is carried out in accordance with the Law of the Republic of Azerbaijan “On Licenses and Permits” No. 176-VQ dated March 15, 2016.
In accordance with Article 6 of Annex No. 1 of the above mentioned Law – “The list of activities requiring a license (with the exception of cases arising from national security”) licenses for the following types of activities are issued by the Ministry of Economy of the Republic of Azerbaijan.

In accordance with Articles 3, 4 and 4-1 of Annex No. 2 of the above mentioned law – “The list of activities requiring a license in cases arising from national security” licenses for the following types of activities are issued by the Ministry of Digital Development and Transport of the Republic of Azerbaijan.

The rates of the state duty for issuing a license for the types of activities requiring a license for carrying out entrepreneurial activity in the Republic of Azerbaijan are determined by Article 22 of the Law of the Republic of Azerbaijan “On State Duty” No. 223-IIQ dated December 4, 2001:
The applicant applies for a license to the issuing authority for the above activities and submits necessary documents for obtaining a license (the application form and the list of required documents are available at this link).
After studying the documents presented by the applicant, and in case of obtaining consent to issue a license, the applicant pays the established state duty, and presents a document on payment to the issuing authority.
If the laws of the Republic of Azerbaijan (with the exception of the Law of the Republic of Azerbaijan “On Administrative Proceedings”) do not specify an earlier period, the issuing authority, having examined the submitted application and the documents attached to it, shall issue a license no later than 10 business days after registration of the application or adopts an administrative act on refusal to issue a license.
Licenses with the exception of licenses for activities for cellular (mobile) communications services (indicating technological standard) are issued indefinitely.
A license for the provision of cellular (mobile) communication services (indicating technological standard) is issued for a period of 10 years. At the same time, within 30 days after the issuance of a license for this type of activity, an agreement must be signed between the licensee and the issuing authority. If a license agreement is not signed, a license for this type of activity does not create legal consequences.
Control over the complience with the license terms by the licensee is carried out in accordance with the laws of the Republic of Azerbaijan regulating the relevant field.
Within control of compliance with license terms, on-site inspections are carried out in accordance with the laws of the Republic of Azerbaijan “On regulation of inspections in the field of entrepreneurship and protection of interests of entrepreneurs” and “On termination of inspections in the field of entrepreneurship ”.
When carrying out the types of activities provided for in Annex 1 of the Law of the Republic of Azerbaijan “On Licenses and Permits” No. 176-VQ dated March 15, 2016, the supervisory authority who identifies the licensee’s non-compliance with the requirements of the laws of the Republic of Azerbaijan and the license terms submits a reasoned submission to the licensing authority to suspend and revoke a license.
