Department of Human Resources Management and Civil Service

 

1.

General provisions

 

1.1.

The Department of Human Resources Management and Civil Service of the Ministry of Transport, Communications and High Technologies of the Republic of Azerbaijan (hereinafter – the Department) is the structural unit of the Ministry of Transport, Communications and High Technologies of the Republic of Azerbaijan (hereinafter – the Ministry), which provides the implementation of normative legal acts adopted in the field of public service and labor legislation, coordination of activities for the human resources management in the bodies that are included in the structure of the Ministry and subordinate bodies not included in its structure.

 

1.2.

In its activity, the Department is guided by the Constitution of the Republic of Azerbaijan, the laws of the Republic of Azerbaijan, decrees and orders of the President of the Republic of Azerbaijan, decisions and orders of the Cabinet of Ministers of the Republic of Azerbaijan, “ Regulations on the Ministry of Transport, Communications and High Technologies of the Republic of Azerbaijan”, other legislative acts, decisions, orders and instructions (hereinafter – organizational and administrative documents) of the Minister of Transport, Communications and High Technologies (hereinafter – the Minister), decisions of the Board of Ministry and these Regulations.

 

1.3.

While carrying out its duties and exercising its rights the Department interacts with structural units and bodies of the administrative office of the Ministry, as well as central and local executive authorities, self-governing bodies, and non-governmental organizations.

 

2.

Areas of activity of the Department

 

2.0.

The areas of activity of the Department are as follows:

 

2.0.1.

develops and implements a system of measures for the development of human resources, including studies the demand for highly qualified personnel in the relevant field, provides personnel training, takes measures for education and additional training of specialists;

 

2.0.2.

exercises general control over compliance with the requirements of legal acts on public service and labor legislation in the bodies of the Ministry;

 

2.0.3.

carries out methodical and practical management with a view to conducting civil service and human resources in the bodies of the Ministry;

 

2.0.4.

provides the development of the relevant field;

 

2.0.5.

carries out activities in other areas determined by the Minister in accordance with the law.

 

3.

Duties of the Department

 

3.0.

The Department performs following tasks in accordance with the directions of activity defined by these Regulations:

 

3.0.1.

to prepare drafts of organizational and administrative documents for the directions of activity or participate in their preparation;

 

3.0.2.

to provide the organization and implementation of activities in the field of forecasting human resources of the Ministry, formation of reserve personnel, managing personal records of civil servants, human resources management;

 

3.0.3.

to identify training needs of employees, increase professional skills, organize measures (meetings, workshops, educational work, trainings, etc.) on issues of ethical behavior and labor discipline together with relevant bodies;

 

3.0.4.

to coordinate its activities in the field of professional training, re-training and advanced training of employees with other central executive authorities of the Ministry, analyze the situation and prepare proposals in this area;

 

3.0.5.

to submit relevant information required for admission to civil service and for filling administrative positions timely as intended and take necessary measures for holding support posts that are not considered civil services;

 

3.0.6.

to take necessary measures to conduct register of civil servants and other databases established in connection with civil service and provide monthly provision of official information on changes occurred in the data included in the register to public authority which maintain records;

 

3.0.7.

to gather information about service activities of employees, update and analyze, their selection and placement through promotion , awarding initial and subsequent professional ranks to civil servants, to use this information for solving civil service and other issues related to labor contracts;

 

3.0.8.

to prepare strategies, programs and other documents on the development and management of human resources for specified periods, organize their implementation;

 

3.0.9.

to organize work on the evaluation of performance and appraisal of employees;

 

3.0.10.

to exercise general control over the process of performance appraisal;

 

3.0.11.

to provide the management of the Ministry with human resources management situation and data on official activity and labor discipline of employees;

 

3.0.12.

to provide the implementation of effective and sustained personnel policy, objectivity, equality, impartiality and transparency in human resource management;

 

3.0.13.

to resolve proposals of heads of agencies and requests of employees on transfer of employee from one job to another in accordance with the legislation;

 

3.0.14.

to take measures for issuance of work record books , filling out work record books, their registration and maintenance;

 

3.0.15.

to conduct work on military registration and reservation;

 

3.0.16.

to take measures in connection with the preparation of leave schedules and the granting vocation leaves to employees in accordance with the law, conducting their registration, providing employer’s references, arranging business trips and keeping their records;

 

3.0.17.

to prepare job descriptions for positions in the government together with heads of structurel units of the administrative office of the Ministry and bodies that are included in its structure;

 

3.0.18.

to carry out practical and methodical guidance for conducting personnel work in the bodies of the Ministry, supervise the organization of this work within its powers;

 

3.0.19.

to provide the preparation and provision of necessary documents of the Ministry’s employees within the limits of their powers for pension provision and make proposals on awarding state decorations, honorary titles and the title “Veteran of Labor” to employees;

 

3.0.20.

to organize a solemn swearing-in ceremony of civil servants who are admitted to the permanent civil service for the first time in the manner prescribed by the Law “On Public Service” of the Republic of Azerbaijan;

 

3.0.21.

to establish relations and maintain cooperation with organizations, including scientific organizations operating in the field of the development and increas of human resources capacity;

 

3.0.22.

to monitor compliance with the rules of ethical conduct and labor discipline, as well as attendance by employees of the Ministry, bodies that are included in its structure and subordinate bodies not included in its structure;

 

3.0.23. 

to take the measures necessary in the manner and terms established by law, to bring to disciplinary action employees who violate the rules of ethical conduct and labor discipline;

 

3.0.24.

to organize practice for students (hereinafter – students) of higher (secondary) educational institutions in the agencies of the Ministry;

 

3.0.25.

to provide the consideration of applications and requests received from citizens, government authorities, institutions, enterprises and organizations in a manner as provided in the legislation;

 

3.0.26.

to provide the implementation of the concept (strategic plan) in the field of activity of the Ministry;

 

3.0.27.

to prepare work plan of the Department, reports on its activities for the periods;

 

3.0.28.

to perform other duties in accordance with the directions of activity as stipulated by law.

 

4.

Rights of the Department

 

4.0.

The Department has following rights to fulfill its duties:

 

4.0.1.

to participate in the preparation of drafts of legislative acts, international agreements, organizational and administrative documents by agencies of the Ministry in the relevant field and make relevant proposals;

 

4.0.2.

to make proposals to the Minister together with relevant bodies on awarding initial and subsequent professional ranks to civil servants depending on their position and length of service as well as taking into account their professionalism, performance of management experience and indicators in the performance of job duties;

 

4.0.3.

to give opinion on directions of activity, carry out analysis and make general conclusions, give the heads of bodies of the Ministry practical and methodological recommendations on human resource management;

 

4.0.4.

to prepare proposals to improve the efficiency and eliminate shortcomings in the agencies of the Ministry in the field of human resources management;

 

4.0.5.

to make request in the appropriate manner to the agencies of the Ministry and receive from them relevant information (documents) in connection with the performance of duties specified in these Regulations;

 

4.0.6.

to provide methodological and practical guidance on the development of job descriptions by the agencies of the Ministry;

 

4.0.7.

to prepare or participate in making proposals for the regulation and improvement of activities in the field of human resources;

 

4.0.8.

to prepare relevant documents in connection with the selection and appointment of employees, their admission to civil service, termination of labor contracts, rotation of staff, awarding, taking disciplinary action, send on a business trip, grant vacation time, awarding professional ranks to civil servants, as well as human resource management;

 

4.0.9.

to participate in holding competions and interviews for filling administrative positions and admission to civil service on vacant positions in the Ministry;

 

4.0.10.

to cooperate with other state agencies carrying out activities in the field of human resource management in order to exchange experience;

 

4.0.11.

to explain to employees of the Ministry the rules of ethical conduct and labor discipline;

 

4.0.12.

to study the state of ethical behavior and labor discipline of ministry employees and summarize information about it;

 

4.0.13.

to cooperate with government bodies, non-governmental organizations, the media and independent experts on the ethical conduct of public servants;

 

4.0.14.

to carry out monitoring, internal investigations and checks in connection with cases of violation of the requirements of the provisions of the rules of ethical conduct and labor discipline by employees and make proposals to the management of the Ministry about their results;

 

4.0.15.

to invite employees of the agencies of the Ministry, individuals and legal entities to the Department, receive the necessary information, references and explanations from them for the implementation of the tasks defined by these Regulations;

 

4.0.16.

to develop the structures of agencies on the basis of proposals of agencies of the Ministry and submit them for approval to the Minister;

 

4.0.17.

to study and analyze the state of provision of gender equality among employees of the ministry’s agencies and make appropriate proposals to the management of the Ministry in order to ensure gender equality;

 

4.0.18.

to take measures to promote gender equality and gender-based approaches in the agencies of the Ministry;

 

4.0.19.

to make proposals to the management of the Ministry on the appointment of practical leaders for students from among the employees of the Ministry, as well as on places of practice based on the training program;

 

4.0.20.

to control the organization of internships by students in the agencies of the Ministry, as well as provide practical and methodological guidance;

 

4.0.21.

to represent the Ministry before state bodies, local self-governing agencies, legal and physical persons on issues related to its activity, protect its rights and interests;

 

4.0.22.

to participate and represent the Ministry in the work of commissions, working groups set up in the Ministry and other state bodies, local and international events of various levels on issues related to its activities;

 

4.0.23.

to take measures for the preparation of highly qualified personnel;

 

4.0.24.

to request, summarize and present to the management of the Ministry statistics and reports on human resources management from the agencies of the Ministry;

 

4.0.25.

to study the experience of foreign countries in accordance with the directions of activity and make proposals for the improvement of activities in this direction;

 

4.0.26.

to exercise other rights in accordance with the areas of activity as provided for in the legislation.

 

5.

Organization of activity of the Department

 

5.1.

The structure and staff number of the Department are approved by the Minister.

 

5.2.

The Department is headed by head of department, who is appointed and dismissed by the Minister.

 

5.3.

Head of department is personally responsible for carrying out the duties assigned to the Department and implementation of rights.

 

5.4.

In the absence of the head of department, one of administrative officers carries out his duties in the prescribed manner.

 

5.5.

Other employees of the Department are appointed and dismissed by the Minister.

 

5.6.

head of department:

 

5.6.1.

organizes the activities of the Department and heads it;

 

5.6.2.

provides the fulfilment of duties assigned to the Department;

 

5.6.3.

exercises control over the obvservance of labor discipline by employees of the Department, supervises timely and proper execution of their duties;

 

5.6.4.

gives binding instructions to the employees of the Department;

 

5.6.5.

makes proposals to the Minister in connection with disciplinary proceedings and the promotion of employees of the Department;

 

5.6.6.

conducts assessment of the official activities of public servants employed in the Department;

 

5.6.7.

represents the Department.

 

5.7.

The employees of the Department bear responsibility for the violation of the requirements of these Regulations in the manner established by law of the Republic of Azerbaijan.

 

5.8.

Each employee of the Department is responsible for confidentiality of data that is known to him and data containing state or business secret in accordance with their duties and powers.
