1.

General provisions

 

1.1.

The Department for International Cooperation of the Ministry of Transport, Communications and High Technologies of the Republic of Azerbaijan (hereinafter – the Department) is a structural unit of the administrative office of the Ministry of Transport, Communications and High Technologies of the Republic of Azerbaijan (hereinafter – the Ministry), which ensures the implementation of activities related to international cooperation in the field of transport, communications and high technologies.

 

1.2.

In its activity, the Department is guided by the Constitution of the Republic of Azerbaijan, international treaties to which Azerbaijan is a signatory, laws of the Republic of Azerbaijan, decrees and orders of the President of the Republic of Azerbaijan, decisions and resolutions of the Cabinet of Ministers of the Republic of Azerbaijan, “Regulations on the Ministry of Transport, Communications and High Technologies of the Republic of Azerbaijan”, decisions, orders and instructions (hereinafter – organizational and administrative documents) of the Minister of Transport,Communications and High Technologies (hereinafter – the Minister), the decisions of the Board of the Ministry, other legal acts and these Regulations.

 

1.3.

When carrying out its duties and exercising rights, the Department interacts with structural units of the administrative office of the Ministry, and bodies that are included in its structure, and subordinate bodies that are not included in its structure.

 

2.

Areas of activity of the Department

 

2.0.

The main areas of activity of the Department are as follows:

 

2.0.1.

provides the implementation of cooperation with foreign countries and international organizations in the relevant field and determines its main directions, makes relevant proposals in this area;

 

2.0.2.

participates in the work of intergovernmental economic commissions and working groups, organizes the work of intergovernmental economic commissions and working groups, the co-chair of which is the Ministry and supervises the work of expert groups in this area;

 

2.0.3.

participates in the development of drafts of regulatory legal acts related to the activity areas of the Department;

 

2.0.4.

participates in the preparation of tender documents for international investment projects financed by the state budget, loans, grants, technical assistances and other sources envisaged by the legislation and invites tenders in accordance with the legislation;

 

2.0.5.

It is represented in working groups and project management teams on international projects implemented in the relevant field, participates in the coordination and management of projects;

 

2.0.6.

examines proposals of foreign partners jointly with relevant structural units of the administrative office of the Ministry and its subordinate bodies, and informs the management of the Ministry on it, prepares proposals for the beginning and development of cooperation, organizes and directs the relevant negotiations and mutual discussions;

 

2.0.7.

prepares drafts of international documents in this relevant field (contracts, memorandum of understandings, protocol of intention, agreement), orginizes their submission to the relevant structural units of the Ministry and concerned bodies, as well as the Ministry of Foreign Affairs of the Republic of Azerbaijan and , if necessary, to other central executive powers for consideration;

 

2.0.8.

submits proposals to establish and improve relations with relevant government agencies and international organizations, takes measures to represent the Ministry at international events and makes proposals on other participators;

 

2.0.9.

participates in events held in international organizations to represent and protect the country's interests in the relevant field, and assumes as a basis the recommendations and instructions of the Ministry of Foreign Affairs of the Republic of Azerbaijan, as well as specific instructions and guidance of the Minister;

 

2.0.10.

maintains a register of international documents signed in the relevant field, monitors the performance of commitments and planned work, makes proposals for the establishment of appropriate working groups in this respect;

 

2.0.11.

exercises control over the international activities of the staff of the Ministry, bodies that are included in its structure and subordinate bodies that are not included in its structure, arranges business trips and international events for its employees, as well as gives opinions on the use of loans, grants, technical assistance and other means funded by International Financial Institutions and makes appropriate proposals;

 

2.0.12.

carries out work related to the organization of international events (exhibitions, forums, conferences, etc.) in the country and abroad, organizes visits of the delegation consisting of representatives of the Ministry and subordinate bodies participating in events abroad;

 

2.0.13.

Deals with organizational and protocol issues for guests invited by the Ministry;

 

2.0.14.

carries out activities in other areas provided by the legislation of the Republic of Azerbaijan.

 

3.

Duties of the Department

 

3.0.

The Department fulfills following duties according to the areas of activity as defined by these Regulations:

 

3.0.1.

to implement comprehensive measures and provide methodological and practical guidance to the Ministry and its subordinate organizations in order to establish a unified international cooperation in the relevant field;

 

3.0.2.

to take measures to build relationships with diplomatic missions of foreign countries accredited in the Republic of Azerbaijan, diplomatic missions of the Republic of Azerbaijan in foreign countries, international and regional organizations, transnational, international and local companies engaged in commercial and non-commercial activities in this area, public associations, business clubs, non-governmental organizations, universities, research institutes and think tanks, and to exercise control over these activities within its powers;

 

3.0.3.

to provide protection of interests and rights of the Ministry and its subordinate bodies in the field of international relations, to exercise control over the activities of their structural units (department, sector and coordinators) in international relations, to make appropriate proposals to improve their activities;

 

3.0.4.

to prepare international, bilateral and intergovernmental documents (agreement, memorandum of understanding, protocol of intention and etc.) public and private institutions of foreign countries in the relevant field, as well as to represent the Ministry in negotiations and discussions on this issue, in special cases to lead negotiations;

 

3.0.5.

to study and analyze transport processes and technological trends in the world, and to assess the impact of those processes on strategic international transport and communications projects;

 

3.0.6.

to participate in the development and submission of proposals for the development of international transport corridors passing through the territory of the Republic of Azerbaijan and increasing their competitiveness, and in the development of state programs and make proposals to improve the efficiency of freight and passenger traffic in the transport and road complex;

 

3.0.7.

to make proposals on strategic directions to accelerate international integration and sustainable development in the relevant area;

 

3.0.8.

to prepare proposals for analyzing the international transport services market in the relevant field and protecting national carriers’ interests and present them accordingly;

 

3.0.9.

to make proposals on participation of representatives (heads, employees and specialists) of the administrative office of the Ministry and subordinate bodies in international events (exhibitions, conferences, workshops, courses, meetings, presentations, banquets, etc.) in the relevant field and in this regard, investigate the proposals of the heads of structural units and subordinate bodies of the administrative office of the Ministry and determine the need for their participation in such events;

 

3.0.10.

to carry out comprehensive measures to invite experts from foreign countries and organize their activities in Azerbaijan in order to improve the activities of the Ministry and subordinate organizations;

 

3.0.11.

to obtain information in advance on international documents that must be signed by the administrative office of the Ministry and subordinate bodies included in its structure and not included in its structure, talks with foreign states, international organizations and international financial institutions and their wish to hold international events in our country, give relevant opinions and make proposals in this regard;

 

3.0.12.

to conduct negotiations with international donor organizations and international financial institutions, and make appropriate proposals to benefit from their loans, grants, technical assistance and other instruments;

 

3.0.13.

to organize visits of representatives of foreign countries invited by the Ministry and its subordinate bodies and to resolve organizational and protocol matters etc.) and to lead this work (to work out programs of visits);

 

3.0.14.

to plan, organize and record meetings of the Minister, Deputy Ministers with ambassadors, consuls and trade representations of foreign countries, as well as heads and representatives of international organizations and foreign companies accredited in the Republic of Azerbaijan;

 

3.0.15. 

to ensure the preparation of appropriate notes and letters of support in order to obtain visas from different countries for the Ministry’s employees going on an official business trip and provide them with necessary assistance;

 

3.0.16.

to carry out other duties entrusted to the Department by orders and instructions of the Minister.

 

4.

Rights of the Department

 

4.0.

The Department has the following rights for implementation of its duties:

 

4.0.1.

to sign documents related to the powers, duties and functions of the Department in agreement with the management of the Ministry;

 

4.0.2.

to establish direct relations with public and private bodies of other states in the relevant field, other state authorities of the Republic of Azerbaijan, as well as structural subdivisions and subordinate bodies of the Ministry with the agreement of the management of the Ministry in connection with issues regarding to the powers of the Department ;

 

4.0.3.

to receive necessary materials, information, reports and documents from the structural units and subordinate bodies of the Ministry, other enterprises, departments and organizations, their officials to carry out the tasks defined by these Regulations, to maintain correspondence and email exchange;

 

4.0.4.

to submit proposals to the Ministry on the development of its international (foreign) relations, as well as on improving the work of the Department;

 

4.0.5.

with the agreement of the heads of other structural subdivisions and subordinate organizations of the Ministry, to involve their employees in the organization of activities envisaging the implementation of the main tasks and functions of the Department, to create working groups and to demand that the planned work should be executed;

 

4.0.6.

to participate in the discussions on the functions of the Department, in the work of commissions, advisory and coordinating bodies established in the Ministry and subordinate organizations, taking into account the requirements of the legislation;

 

4.0.7.

to provide subordinate agencies with guidance on their international cooperation activities;

 

4.0.8.

to conduct long-distance and international telephone calls regarding issues relating to the powers of the Department with the agreement of the management of the Ministry;

 

4.0.9.

to carry out other duties provided for in the legislation according to the areas of activity.

 

5.

Organization of the activity of the Department

 

5.1.

The structure and staff number of the Department are approved by the Minister.

 

5.2.

The structure of the Department includes Sector for Work with International Organizations, Interstate Cooperation Sector, International Events and Protocol Sector and International Projects sector. Sectors provide for the implementation of the tasks assigned to the Department by these Regulations.

 

5.3.

The Department is headed by head of department, who is appointed and dismissed by the Minister.

 

5.4.

Head of department is personally responsible for the organization of activities of the Department, carrying out the duties assigned to the Department and the implementation of rights.

 

5.5.

Head of department has a deputy, who is appointed and dismissed by the Minister.

 

5.6.

Deputy head of department is personally responsible for the performance of duties assigned to him/her by the head of the department and the exercise of the rights.

 

5.7.

In the absence of the head of department, deputy head of department carries out his/her duties in the established manner.

 

5.8.

Other employees of the Department are appointed and dismissed by the Minister.

 

5.9.

head of department:

 

5.9.1.

organizes the activity of the Department and heads it;

 

5.9.2.

makes distribution of division of work among the employees of the Department, carries out control over the timely and proper performance of duties by employees, labor discipline and compliance with internal regulations, as well as the annual performance assessment of its employees;

 

5.9.3.

if necessary, represents the Department at board meetings and other high-level meetings of the Ministry;

 

5.9.4.

represents the Ministry in the higher authorities, other ministries and government agencies, international organizations, abroad on the instruction of the management of the Ministry and protects its interests;

 

5.9.5.

accompanies the Minister on visits to foreign countries, maintains minutes of meetings, prepares and submits to the Minister a draft report on the results of visits to be submitted to relevant higher authorities;

 

5.9.6.

provides clerical work in the Department in accordance with the “Instructions for clerical work in state authorities, in legal entities and state-funded organizations, the control package of shares of which belongs to the state”;

 

5.9.7.

submits proposals on assignment to positions in the Department, assignment of professional degrees to employees, organization of professional development, changing of staff schedule;

 

5.9.8.

submits representations for provision of the Department with logistic equipment, communication and transportation, as well as organization of social welfare of the employees in accordance with established order by the relevant structural units of the Ministry;

 

5.9.9.

takes other measures within his authorities for implementation of duties and functions entrusted to the Department.

 

5.9.10.

represents the Department.

 

5.10.

The employees of the Department bear responsibility for the violation of the requirements of these Regulations in the manner established by law of the Republic of Azerbaijan.

 

5.11.

The employees of the Department are responsible for confidentiality of data that is known to them and data containing state or business secret in accordance with their duties and powers.
